LERC Upholds Tariff Decision, Dismisses LIBENERGY’s Appeal

MONROVIA, Liberia – The Liberia Electricity Regulatory Commission (LERC) has dismissed LIBENERGY’s request for reconsideration of the Commission’s July 6, 2026 tariff decision, paving the way for the approved electricity tariff to take effect on November 1, 2026.

According to a release issued by the Commission, the decision followed a thorough review of LIBENERGY’s application, supporting submissions, the tariff record, and the relevant provisions of the Electricity Law of Liberia, 2015. The Commission concluded that the utility failed to present any legal, factual, or procedural grounds to warrant a review of its earlier decision.

The release said LIBENERGY had requested the reinstatement of its proposed energy charge of US$0.25 per kilowatt-hour (kWh), arguing that the approved tariff of US$0.22/kWh was not cost-reflective. Alternatively, the company sought to delay implementation of the approved tariff.

According to the Commission, the issues raised in the application repeated arguments that had already been fully considered during the tariff review process and did not identify any material error of law or fact. As a result, the request for reconsideration was denied.

Despite rejecting the appeal, the Commission exercised its regulatory authority to defer implementation of the approved tariff from August 1 to November 1, 2026. The release explained that the extension is intended to allow LIBENERGY to complete a previously granted four-month compliance period to address identified service delivery deficiencies.

The Commission emphasized that the postponement does not alter or reverse its tariff determination, nor does it validate LIBENERGY’s claim that the approved tariff is not cost-reflective. Rather, the extension is intended solely to provide the utility with additional time to implement corrective measures and demonstrate measurable improvements in the quality, reliability, and efficiency of its services before the new tariff takes effect.

The release further quoted LERC Chairman Hon. Claude J. Katta, speaking on behalf of the Commission, as reaffirming LERC’s commitment to protecting the public interest through transparent, fair, and evidence-based regulation. He assured customers, stakeholders, and local government officials that the Commission will continue to closely monitor LIBENERGY’s compliance with its regulatory obligations and service improvement commitments to ensure consumers receive safe, reliable, and efficient electricity services.

With the Commission’s decision, the approved electricity tariff remains unchanged and will take effect on November 1, 2026.
